Terms & Conditions: Service Agreement & Customer Policies
Welcome to Tim’s Plumbing & HVAC. By scheduling a service, requesting an estimate, or using our website, you agree to comply with and be bound by the following Terms and Conditions. These terms govern the professional relationship between Tim’s Plumbing & HVAC ("we," "us," or "our") and the customer ("you" or "property owner").
Please read this document carefully before authorizing any plumbing or HVAC work. If you have questions regarding these terms, our team is available to assist you at 844-973-0400.
1. Scope of Services & General Terms
Tim’s Plumbing & HVAC provides professional residential and commercial plumbing, heating, and cooling services. The exact scope of work for any project will be detailed in a written job order, estimate, or invoice provided prior to or upon completion of the service.
-
Authorized Access: By scheduling service, you grant our technicians permission to enter the designated property at the agreed-upon time to inspect, diagnose, repair, or install plumbing and HVAC systems.
-
Adult Representation: An authorized adult (18 years or older) with the legal authority to sign work orders and approve expenses must be present on the property during the entire service visit.
-
Property Conditions: Homeowners and property managers are responsible for ensuring clear, safe, and unobstructed access to all working areas, including mechanical rooms, basements, crawlspaces, main shut-off valves, and cleanouts.
2. Estimates, Pricing, and Payment Terms
We believe in transparent, upfront communication regarding all costs.
Diagnostic & Service Call Fees
A standard diagnostic fee applies to dispatch a technician to your property and evaluate your plumbing or HVAC system. This fee covers professional time, vehicle dispatch, and advanced diagnostic tools (such as leak detectors or drain cameras). The technician will provide a flat-rate or detailed quote before performing repairs.
Payment Terms
-
Immediate Payment: Payment in full is due immediately upon completion of services, unless prior written arrangements have been established.
-
Accepted Payment Methods: We accept major credit cards, debit cards, checks, and approved financing options.
-
Late Fees: Unpaid balances beyond the agreed terms may be subject to a late fee of 1.5% per month (or the maximum allowed by law), as well as any legal or collection fees incurred to collect the debt.
Material Upgrades and Unforeseen Conditions
Plumbing systems are often concealed behind walls, under concrete slabs, or underground. Quotes are based on visible conditions. If concealed or unexpected hazards are uncovered during work—such as rotted subfloors, illegal past installations, code violations, collapsed piping, or asbestos—our technicians will pause work and present a revised estimate for your approval before proceeding.
3. Cancellations, Rescheduling, and Missed Appointments
We value your time and reserve specific time slots for every customer.
-
Cancellation Notice: If you need to cancel or reschedule a non-emergency appointment, please notify us at least 24 hours in advance by calling 844-973-0400.
-
Missed Appointments / Lockouts: If our technician arrives within the agreed-upon service window and cannot gain access to the property or contact the authorized representative, a trip fee may be assessed.
4. Workmanship Guarantees & Warranties
We take pride in delivering high-quality craftsmanship using industry-standard tools and practices.
Service Warranties
-
Labor Warranty: Labor on standard repairs and installations is covered under our standard limited warranty for a period specified on your official invoice.
-
Manufacturer Warranties: Parts, fixtures, water heaters, and HVAC equipment are covered by their respective manufacturers' warranties. Tim’s Plumbing & HVAC does not manufacture these components and is not liable for manufacturer defect claims, though we will assist in facilitating warranty replacements where applicable.
Warranty Exclusions
Our service warranty becomes null and void if:
-
The repaired system or fixture is modified, tampered with, or serviced by an unauthorized third party or the homeowner after our work is completed.
-
The issue is caused by homeowner misuse, neglect, or failure to follow recommended maintenance (e.g., flushing improper items down toilets, allowing pipes to freeze).
-
Existing, aged, or severely corroded piping surrounding the repair site fails independently of our installation.
-
Drain line clearings suffer re-stoppage due to collapsed pipes, heavy root intrusion, structural sag, or foreign objects flushed post-service.
5. Drain Cleaning & Hydro Jetting Disclaimer
Clearing clogged drains, main sewer lines, and stack lines involves mechanical cable machines and high-pressure water jetting.
-
Pre-Existing Pipe Conditions: Aged, rusted, thin-walled galvanized, clay, or brittle orangeburg pipes can fail or collapse during standard drain clearing operations due to existing weakness or heavy corrosion.
-
Limitation: Tim’s Plumbing & HVAC is not liable for pre-existing pipe degradation, root invasion damage, or pipe collapse that occurs during normal, standard drain cleaning procedures. If a camera inspection reveals structural pipe damage, permanent pipe restoration or trenchless repair options will be quoted.
6. Emergency Plumbing Services
Emergency response is provided subject to technician availability, severe weather conditions, and safety considerations.
-
After-Hours Rates: Emergency services requested outside standard business hours, on weekends, or during official holidays are subject to higher emergency hourly or flat-rate charges, which will be disclosed prior to dispatch.
-
Immediate Shut-Off Responsibility: In catastrophic leak situations, homeowners are urged to turn off the main water shut-off valve immediately while awaiting the arrival of our emergency plumbing crew to minimize property damage.
7. Limitation of Liability & Property Protection
Tim’s Plumbing & HVAC takes every precaution to protect your home or commercial facility during service.
-
Water Damage: Water leaks can cause rapid structural damage, drywall degradation, and mold growth. We are not responsible for pre-existing water damage, hidden leaks that existed prior to our arrival, or secondary damage resulting from a customer delaying necessary repairs.
-
Restoration Work: Unless specifically detailed in the written project scope, standard plumbing quotes do not include drywall repair, painting, tiling, floor replacement, or carpentry work following invasive pipe access or slab leak repairs.
-
Cap on Liability: To the maximum extent permitted by applicable law, our total liability for any claim arising out of our services shall not exceed the total amount actually paid by the customer for the specific job in question.
8. Customer Responsibilities & System Maintenance
Proper maintenance is critical to extending the life of your plumbing and mechanical systems. To maintain warranty protection and ensure system efficiency, property owners should:
-
Maintain indoor temperatures above 55°F during winter to prevent burst frozen pipes.
-
Avoid using harsh chemical drain cleaners, which corrode metal and PVC piping.
-
Schedule annual water heater flushing and preventative plumbing inspections.
-
Immediately report any minor drip, slow drain, or water staining before it escalates into structural damage.
